The Coldfile, legal
Terms of Service
Effective October 18, 2026
The deal
The Coldfile (“the Service”) is a digital interactive narrative product owned and operated by Kevin Alexander Soto Burgos, an individual. These terms apply when you use the Service, and the purchase screen links to them before every purchase. If you don't agree, please don't use the Service.
Who can play
An account is optional. Without one, your purchases are tied to the Google account you buy with, and your progress stays on your device. If you sign in with Google, your purchases and a copy of your progress are also linked to that account. You must be at least 16 years old to use the Service. If you are under the age of majority where you live, you need permission from a parent or guardian to make purchases, and Google Play’s family controls may apply.
What you're buying
When you purchase a case you receive a personal, non-transferable license to play that case on devices signed in to the Google account used for the purchase or, if you use an account, on devices signed in to that account in the app, for as long as we offer the Service. You do not receive copyright in the case content. We retain all intellectual property rights in the writing, art, audio and code. Updates may fix errors or improve a case, but they will not remove the main content of a case you bought or make it substantially worse.
The free first case is licensed to you on the same personal-use basis.
If a case is withdrawn or the Service ends. If we have to withdraw a case you bought or stop offering the Service, we will tell you in the app in advance whenever possible. If a case you bought stops being available to you, you can ask us for a refund of that case.
Refunds
Purchases are made through Google Play, so you can ask Google for a refund under Google Play’s refund policy (support.google.com/googleplay/answer/2479637). You can also email us with your order ID and we will review your request in good faith. If a refund is granted, the case is locked again. These options are in addition to your statutory rights, including the right to a fix or a refund if a case doesn’t work as described.
If you live in the European Economic Area or the UK, where Google is the seller and asks you at checkout to agree to receive the case right away, you normally have 14 days to withdraw from an online purchase. Cases unlock immediately, so once a case is unlocked with your agreement to receive it right away, the right of withdrawal may no longer apply. If a case was unlocked without that agreement, you keep your right to withdraw.
What you can't do
You may not: copy or redistribute case content; reverse-engineer the Service to extract assets, except where the law expressly allows it; attempt to bypass payment to access paid cases.
Third-party services
Payments are made through Google Play. In the European Economic Area, the UK and the other territories Google lists, Google is the seller. In all other countries, including Peru, the seller is Kevin Alexander Soto Burgos and Google Play processes the payment. In both cases, Google’s terms apply to the payment transaction. Purchase entitlements are managed by RevenueCat, app updates are delivered by Expo, and the optional account and cloud saves run on Google Firebase. If a problem with one of these providers stops you from accessing a case you bought, write to us and we will restore your access or, if we can’t, refund that case.
About the content
The cases are fiction. They involve murder and other crimes and may include violence, death and disturbing themes. Names, characters and events are invented, and any resemblance to real people or events is coincidental.
Warranties
We work to keep the Service running, but we can’t promise it will always be available or free of bugs. If a case you bought doesn’t work as described, write to us and we will fix it or, if we can’t, refund it. Apart from that, and to the extent the law allows, the Service is provided “as is”. Nothing in these terms excludes or limits any legal guarantee or consumer right that cannot be waived under the law that applies to you.
Limitation of liability
To the extent the law allows, our total liability to you for any claim related to the Service is limited to the price you paid for the case or cases the claim relates to, and we are not liable for indirect losses that were not reasonably foreseeable. This limit does not apply to liability that the law does not allow us to limit, such as liability for intentional misconduct or gross negligence, and it does not affect your statutory consumer rights. If you are in Peru, this limit does not apply to damage caused by our intentional misconduct or negligence. In no country does it apply to death or personal injury.
Termination
You may stop using the Service and uninstall the app at any time; your purchases stay with your Google account. We may block access to a case only if it was obtained without paying for it, or if you seriously break these terms, for example by redistributing case content. Before blocking a case because of a breach, we will tell you in the app or by email and you will be able to respond. If you think we blocked a case by mistake, write to us and we will review it.
Governing law
These terms are governed by the laws of Peru. If you use the Service as a consumer, you also keep the protection of the mandatory consumer laws of the country where you live, and you may bring a claim in the courts of that country or in the courts of Lima, Peru, as you choose, where the law gives you that option. Nothing in this section limits rights that the law of your country does not allow to be waived.
If you are in Peru, you can also file a claim or complaint in our virtual Complaints Book (Libro de Reclamaciones) at coldfile-legal.kevin2005-10.workers.dev/libro-de-reclamaciones. We answer within 15 business days at the email you give us. You can also go to Indecopi.
Changes
We may update these terms, for example when the app or the law changes. We will publish the new version in the app, update the effective date, and point out important changes in the app. Changes do not reduce what you get with cases you already bought. If you don’t agree with the new terms, you can stop using the Service and you keep your rights over past purchases.
General
If any part of these terms is found invalid, the rest stays in effect. These terms are available in English and Spanish; both versions are equally valid, and if they differ, the reading more favourable to you applies.
